Subject: The Lokpal and Lokayuktas Act, 2013- Submission ofdeclaration of assets and liabilities by CSS officers for each year- regarding.

The undersigned is directed to refer to this Department’s O.M. of even number dated 9.4.2015 followed by reminders dated 23.04.2015, 16.7.2015 and 25.08.2015 and to say that all CSS officershave been requested to file the returns as required under the Lokpal and Lokayuktas act 2013 as on 1.8.2014 and for the year 2015 (as on 31.3.2015) online at cscms.nic.in. However, the returns have been filed only by a very few CSS officers whereas the last date for submission of the same is fast approaching which is 15.10.2015.CSS officers who have not yet submitted the returns are requested to submit the same immediately without waiting for the last date to approach to avoid rush and slowing down of the system at the last moment. All officers of US and above levels of CSS should also take a print out of the return filed online and submit to thisDepartment duly signed.

2. Ministries/Departments are requested that the contents of this O.M. may be circulated among all CSS officers working under their control. They should also monitor and ensure that the returns are submitted by all CSS officers within the stipulated period without fail through Web Based Cadre Management System.

Compulsory Retirement - a Difficult Task for the Government…

Compulsory Retirement to Central Government Employees on the Basis of their Efficiency may be a Difficult Task for the Government…

Recently, the Central Government had issued an order (No.25013/01/2013-Estt.A-IV) regarding strengthening of administration by executing compulsory retirement to the central government employees who are found to be inefficient, incapable or unable to fulfill the targets set by their higher authorities, after completing certain years of service.
The order brought panic among employees and questions arise how to identify those employees who are given compulsory retirement. The order was issued on the basis of CCS (Pension) Rule 56 (j) and Rule 48 which explains the above points. The government had clarified that if the order comes into effect, it won’t be treated as a punishment to the employees.
Article 311 of the Constitution of India says that the government should ensure security to an employee. As per the Rule, an employee should be well informed of any actions to be taken against him and be to given opportunity to explain on his part. But this rule is not applicable to criminal offences or against the security of the country.
The order which was released by DOPT, with some Supreme Court orders was a little bit strong than the previous ones. But it will not be an easy exercise for the government to implement the order as it has to face strong opposition from the employees, Trade Unions and Federations.
To analyze and determine employees’ efficiency was always a headache for the government. In the 6th CPC, the commission recommended special yearly increment to 20% of the central government employees in each department for outstanding performance on their field. But no such appreciations had happened so far in any of the departments.
Let us wait and see what will happen next….!

Full Pension on less than 30 years & more than 20 years of Qualifying Service for Pre-2006 pensioners

In view of the fact that review Petition filed by UOI RP (C) NO. 2565/2015 in SLP (C) No. 6567/2015 UOI Vs M.O. Inasu dismissed by HSC on 28.8.2015, and Following file notings of DOPW (obtained under RTI) let us hope DOP&PW will now issue necessary instructions extending benefit of full min. pension to all pre 2006 pensioners irrespective of Q.S. rendered.

12. It may be mentioned that in its order dated 22.1.2013 and 16.8.2013 in OA No. 715/2012 and OA No. 1015/2012 respectively, Hon’ CAT Ernakulam Bench directed that the revised pension fixed in terms of para 4.2 of OM dt. 1.9.2008 would not be reduced pro rata in cases where the qualifying service of a pre 2006 pensioner was less than 33 yrs. This order of Hon CAT was challenged by D/o Revenue in the H.C. of Kerala in OP(CAT) No. 4/2012 and No. 8/2012. Hon’ H.C. of Kerala dismissed the Op(CAT) No. 4/2012 and No. 8/2012 vide order dt. 7.1.2014. The SLP filed by the Dept. of Revenue against the order dt. 7.1.2014 has also been dismissed by Hon’ S/C. in its order dated 20.2.2015. Learned ASG, Sjri P.S.Narsimha has advised to file a Review Petition. The concerned file is presently with MOL(CA Section) and Ms. Rekha Pandey, Adv. is drafting the RP.
13. As already mentioned above, in the order dt. 29.4.2013 of Hon HC of Delhi in WP No. 1535/2012, it was observed that the only issue which survived was, with ref. to para 9 of OM dt. 28.1.2013 which makes it applicable from 24.9.2012 instead of 1.1.2006. In view of this observation of the Hon H.C. of Delhi, we may issue orders for giving effect to the OM dated 28.1.2013 w.e.f. 1.1.2006 instead of 24.9.2012. The question whether or not the revised pension in terms of OM 28.1.2013 would be reduced proportionally would be examined once the order of the Hon S.C. in the RP to be filed against dismissal of SLP 21044/2014 is available ( para 12 above)

7. Given the fact the review/curative petition in the same matter has once been dismissed by Hon. Apex Court, as also the fact that Civil Appeal of Ministry of Defence with which the SLPs in question got tagged, has also failed, there is no chance that a review petition may yield a different result. On the other hand this will not only engage the govt. machinery in uncessary litigation but will also result in attendant avoidable expenditure. ( emphasis added)

            I am directed to refer to your Circular No.PF-PJCA/2015 dated 12th August, 2015 on the above mentioned subject and to send herewith the following point wise information relating to the Charter of Demands:-



      (i)     Include GDS in 7th CPC for wage revision and other service related matters:-

 Ministry of Finance has not agreed to the proposal of this Department for inclusion of GDS within the purview of 7th CPC inspite of several attempts. 



(ii)    Implement cadre Restructuring proposal in all cadres including Postal Accounts and MMS in Department of Posts:-



Cadre restructuring proposal of Group ‘C’ employees:  The proposal is pending with the Department of Expenditure, M/o Finance at present.



The Cadre Restructuring proposal of Stenographers cadre is under examination.



Postal Accounts Cadre: Regarding restructuring of Sorter, LDC and DEO cadre in PAO’s, views of both the Associations viz. AIPAEA, BPAOEA have been called for vide letter dated 29th June, 2015. It would be processed further on receipt of necessary inputs from them.



MMS Cadre:  The case of MMS is under process.



(iii)    Fill up vacant posts in all cadres of Department of Posts :-



(a)    As regards vacancies of LDC/JA/Stenographers under DR quota the necessary details have been uploaded on the SSC’s Website.  Further action would be taken on receipt of dossiers from the SSC. 



(b)    Abeyance order dated 27-04-2015 issued in r/o PA/SA DR Exam 2014 has been revoked in 10 Circles namely Andhra Pradesh, Assam, J&K, Karnataka, Kerala, North East, Odisha, Tamil Nadu, West Bengal and Punjab and these Circles will now be filling up PA/SA DR 2014 held up vacancies.



(c)   Work of conduct of PA/SA DR Exam for the vacancies of 2015-16 has been entrusted to the SSC and in its notification dated 13-06-2015, 3506 vacancies have been announced to be filled up.            Examination is scheduled in the month of November, 2015.

(d)  The necessary instructions have been issued to fill up the vacancies in Postman/Mailguard and MTS cadre and circles are in the process of filling up these vacancies.



(e)    Instructions already exist for filling up of vacant posts of GDS Mail Man.



2.       In view of the fact that all the issues are under active consideration and being processed, the Federations are advised to cancel the Dharna as no useful purpose is served through agitations/dharnas.

வாய்வார்த்தைகளில் மாயஜாலம் காட்டி ஆட்சிக்கு வந்த இவர்களுக்கு மக்கள் அளிப்பர் கட்டாய ஓய்வு விரைவில்.........

Inefficient அரசு ஊழியருக்கு கட்டாய ஓய்வு என்பதில் நமக்கு இருவேறு கருத்து இல்லை. ஏற்கனவே  அதிகாரிகளின் (அதிகார வர்க்கத்தின்)  பிடியில் ஊழியர்கள் படும் அவஸ்தை ஏராளம்.  இதில் முடிவெடுக்கும் அதிகாரம் யாருக்கு ? 
Central Govt asked the Departments to move compulsory Retirement proposals in respect of Employees who are inefficient and doubtful Integrity 


To tone up the bureaucratic apparatus and weed out officials of doubtful integrity and efficiency, the government has asked all its departments to identify such public servants and move proposals for their premature retirement. 



The move by the Department of Personnel and Training follows a meeting chaired by Cabinet Secretary P K Sinha recently on mechanisms to be adopted to ensure probity among government servants. 





The departments have been asked to invoke provisions of Fundamental Rule (56 J) to compulsorily retire such officials. 



Under Fundamental Rule 56(J), the government has the "absolute right" to retire, if necessary in public interest, any Group A and B employee, who has joined service before the age of 35 and has crossed the age of 50. 



Under the rules, a C Group government servant, who has crossed the age of 55 can be retired prematurely but action can be taken only if the official is suspected to be corrupt or ineffective. 



Group A comprise officers of All India Services like IAS, IPS, Indian Forest Service, IRS, while Group B consists of non-gazetted officers and Group C clerical and ministerial staff. 



However, action can be taken only against such officers whose annual increment have stood frozen for a few years and have not got promotion in preceding five years. 



The meeting emphasised rotation of officers on sensitive and non-sensitive posts and their review and screening under FR 56(J). 



The DoPT has been asked to monitor implementation and obtain compliance from all ministries in this regard. 



"As this activity is to be completed in a time bound manner, it is requested that priority attention may be paid to it and inputs sent to the internal vigilance section at the very earliest," the notice, sent to all ministries, said.

Made In India Operating System BOSS May Soon Replace Microsoft Windows At All Govt Offices

When it comes to Make in India mission, then why only manufacturing and services? Indian Government wants to use Make in India operating systems as well.

In a new development, it has been revealed that Indian Govt. may replace Microsoft Windows Operating System across all offices with their own, open source OS called Bharat Operating System Solutions (BOSS). For the last three months, vigorous testing was in progress, and the results are satisfactory. In fact, even Indian Army couldn’t break the code of BOSS. 

This week, a high level meeting will be conducted by Union Home Ministry, and a higher, advanced version of BOSS would be unveiled. Announcements regarding replacing Windows OS can be taken during this meeting. 

This goes perfectly in line with earlier Govt. order making it mandatory to use only open source software in Govt. offices.

About BOSS

Developed by National Resource Centre for Free/Open Source Software (NRCFOSS) of India at Centre for Development of Advanced Computing (CDAC), Chennai, BOSS is an open source, Linux based OS. First launched in 2007, the current version of BOSS is 5.0., code named ‘Anokha’. It can support 20 Indian languages, and has been developed keeping in mind various security and operational issues, which are especially relevant for Indian usage. Often described as ‘India’s own PC operating system’, BOSS has been endorsed by the Indian Govt. for adaption and implementation on a large scale.Linux Foundation has already certified BOSS as per Linux Standard Base standard.BOSS had been initially developed for desktop PC usage; it is not yet clear whether it will run on mobile devices as well.

But Why BOSS Now?

As per Edward Snowden’s leaked cables, India is one of the most watched, and scrutinized nations of the world; especially by US and China. We have observed how Chinese hackers are able to break into Indian Government’s servers easily, and steal crucial information.By replacing Windows with BOSS, Indian Govt. can aim for greater protection and more security of its data.

Challenges with BOSS

BOSS was initially launched in 2007, but it saw poor adaption across Govt. offices and departments. In fact, last year when Orissa Primary Education Programme Authority required an OS for 15,000 computers across 3000 schools in the state, they chose Suse Linux OS, as BOSS proved to be ineffective for mass scale implementation.However, the newest version which would be unveiled later this week, has been infused with new codes, and new functionalities, which seems promising. The newer version has been developed by DRDO, Gujarat Technical University and assistance of several private computer geeks has been taken.

The move comes shortly after the Government decided to implement OROP for defence personnel.
OROP already exists for the judges of the Supreme Court, High Court and CAG, the letter stated, written by Shiva Gopal Mishra, Secretary, joint consultative machinery, Central Government Employees.
The letter has been written to the Seventh Pay Commission Chairman Justice Ashok Kumar Mathur.

First Indian-American Woman Postmaster in California in 166 Years

An Indian-American woman Smt Jagadeep Grewal has become the first female to be appointed as the postmaster in Sacramento city in California in last 166 years, a media report said.

Jagdeep Grewal who earned her bachelor's and master's degree from Punjab University, started her career in postal services in 1988 as a window clerk.


Jagdeep Grewal will oversee 1,004 employees who process and deliver mail on 537 city routes and 94 rural routes - and fill nearly 20,000 post office boxes, American Bazaar news portal reported on Wednesday.

Ms Grewal who earned her bachelor's and master's degree from Punjab University, started her career in postal services in 1988 as a window clerk.
She was promoted to the post of manager after five years of service.

Referring to the steep decline in the usage of postal services due to internet and courier services, Ms Grewal said that she looked forward to working with Sacramento's Postal Service employees during a challenging time.

"It is only through joint effort and collaboration that we can truly meet our mission of providing extraordinary service while keeping costs down," Grewal was quoted as saying.

She has also worked as a postmaster in Pacifica-Daly City, California.

The US Postal Service is facing cash crunch and recently reported a net loss of $586 million earlier this year.
