Dopt Minister Clarifies on Retirement Age 58 or 33 Years of Service

In Lok Sabha today(16.12.2015), the Dopt Minister Shri Jitendra Singh said that there is no proposal to reduce the retirement age to 58 years of age or 33 years of service for Central Government employees.

In a written reply for the question regarding the retirement age of Central Government employees in Parliament today (16.12.2015), the concerend Minster of State for Personnel Jitendra Singh said that the there is no such proposal to reduce the retirement age with the connection of 33 years of service.

Rahul hits out at Modi for treating govt employees, workers with a stick

Rahul Gandhi said the Prime Minister thinks that Indian government employees and workers are shirkers as he lambasted the government for attempting to dilute labour laws.
“Like we fought for the rights of farmers, we will fight for the cause of the workers and government employees and stand with them and would not retreat an inch. We will fight BJP, Modi and RSS,” he said amid applause at the 31st Plenary Session of INTUC, the trade union wing of the Congress.
“Prime Minister thinks that the government employees and workers of India are dishonest, work shirkers and could be made to work only by wielding a lathi. He feels labour laws have to be weakened and workers disciplined so that they are forced to work. He wants to bring them on their knees. If you look at the new laws being made in Gujarat, Rajasthan and Haryana, it will become clear that Modi has started a big assault on workers,” he added.
Gandhi said, “I do not agree that our employee or worker is either shirker or indisciplined… Our worker is scared. He is scared of his future, the future of his children. The worker is scared whether the job he has today will be there tomorrow. Will the factory gate open for him tomorrow.”
Insisting that the government should become “judge” between the labourers and the industry and “not advocate” of industry, he told the Prime Minister that if he is able to remove fear from the mind of the workers then India would be able to surpass China in no time.
Rahul also said the PM was merely creating buzzwords. “It started with ‘achche din’, then came ‘Swachch Bharat’, ‘Smart Cities’, ‘Make in India’, ‘Digital India’ and now ‘Accessible India’. God knows which jumla will come out next.”
Rahul Gandhi was accompanied by former prime minister Manmohan Singh and several Congress leaders.

Installation of ATMs at Identified Post offices - Operational Hand Book on ATM

It  has been intimated by Postal Directorate that the concerned stake holders are actively working to complete the ATM installation process as per the DoP schedule but most of the ATM locations are not aware of the instructions relating to ATM implementation process and interim cash management process. Some of the locations are not providing the ATM fit currency notes to the AGS vendor for loading into the ATM machines for enabling the cash live. This is resulting in undue delay in completion of the ATMs rollout.     
           To make the all concerned aware of the ATM Implementation process, Directorate has ordered to   circulate the hand book  to all the P.Os where ATM are going to be installed.

Seventh Pay Commission: Govt to examine minimum pay

            New Delhi: The central government is set to examine the minimum pay, which was recommended by the Seventh pay commission.
           The Implementation cell of the Seventh pay commission recommendation in Finance Ministry is working hard to examine the minimum pay as the pay commission increased the pay gap between the minimum and maximum from existing 1:12 to 1: 13.8.
The government data shows that the pay panel recommended the lowest increase in basic pay i.e. 14.27 per cent since independence.
             Sources in the Finance ministry said there appears to be a pattern of minimum pay not only a particular sector, but other segments are required to study as employees’s body and Trade Unions expressed resentment over the recommendations of the Seventh Pay Commission and demanded at least 40% hike in the pay of various categories of government employees.
“We found through government documentation, that are widely available, the preponderance of the evidence strongly supports the seventh pay commission report complexity.” said sources.
“But, that Implementation cell is concentrated as well on a range of different sectors like allowances, advances and risk-hardship matrix. So we need to look at those particular sections very closely.” he added.
The lowest paid central government employees will actually take home the lower salary than what they are currently drawing after acceptance of the Seventh Pay Commission report without modification.
A lowest paid central government employee, who was appointed in the Grade Pay of Rs 1800 in the end of 2015 in Group A city and he is residing in government- quarter. His will get net pay January 2016 Rs.16,370 in existing pay rules.

The same employee will get net pay in January 2016 under the Seventh Pay Commission recommendation without modification, Basic Pay Rs 18,000 – NPS 10% of basic Pay Rs 1800 – CGEGIS Rs 1500 = Rs 14,700. Accordingly, he will be a loser of Rs 1,670.
A minimum pay of Rs 18,000 per month and a maximum of Rs 2.5 lakh per month has been recommended by the Seventh pay commission, headed by Justice A K Mathur, that presented its 900-page report to Finance Minister Arun Jaitley on November 19.
The The Seventh Pay Commission recommended raise in basic pay, a key segment that determines several allowances, is only 14.27 per cent – the lowest in 70 years. The previous commission had recommended a 20 per cent hike, which the government doubled while implementing it in 2008.
The Commission recommended a 23.55 per cent increase in the cumulative earnings of central government employees.
The figure of 23.55 per cent covers the increases in pay and allowances.
The overall increase in pay and allowances and pensions over the business-as-usual scenario will be 23.55 per cent, the report said.

Rules regarding quoting of PAN for specified transactions amended.


The Government is committed to curbing the circulation of black money and widening of tax base. To collect information of certain types of transactions from third parties in a non-intrusive manner, the Income-tax Rules require quoting of Permanent Account Number (PAN) where the transactions exceed a specified limit. Persons who do not hold PAN are required to fill a form and furnish any one of the specified documents to establish their identity.
              One of the recommendations of the Special Investigation Team (SIT) on Black Money was that quoting of PAN should be made mandatory for all sales and purchases of goods and services where the payment exceeds Rs.1 lakh. Accepting this recommendation, the Finance Minister made an announcement to this effect in his Budget Speech. The Government has since received numerous representations from various quarters regarding the burden of compliance this proposal would entail. Considering the representations, it has been decided that quoting of PAN will be required for transactions of an amount exceeding Rs.2 lakh regardless of the mode of payment.

Pay Commission implementation gazette to be issued in April 

The gazette to put into effect the Seventh pay commission recommendation will be issued in April before the announcement of West Bengal, Assam, Kerala and Tamil Nadu states assemblies’ election in May 2016, which will benefit 50 lakh central government employees and 52 lakh pensioners including dependents, Sources of Finance Ministry said Sunday. Banks cannot attach Pension account to recover loan dues : Madras HC

While allowing a Writ Petition filed by Mrs. A. Muthuiruvakkal of Nagercoil in Kanyakumari district the Madras High Court Madurai Bench of Justice K. Ravichandrabaabu held that a Savings Bank Account maintained primarily for the purpose of depositing monthly pension amount could not be attached by a bank just because the account holder had defaulted repayment of a loan availed from them. The petitioner had challenged an order passed by the State Bank of India on August 13 preventing her from operating the pension account for recovering the outstanding loan amount.

          The counsel for the petitioner Mr.P.Thirumahilmaran submitted that the bank had deducted about Rs.14,681 from the petitioner’s pension account after preventing her from operating the account. It was argued on behalf of the petitioner that putting an S.B. account on hold by passing such an order was impermissible in law as pension amount cannot be attached or recovered for the purpose of recovery of any outstanding amount payable by the petitioner. In support of such contention, the petitioner relied on a decision of the Supreme Court reported in Radhey Shyam Gupta Vs. Punjab National Bank and another wherein the Apex Court had criticized the Rajasthan High Court for ordering attachment of even Fixed Deposits without giving attention to the fact that the loan defaulter in that case had actually converted his pension and gratuity amount into fixed deposits. The bank on its part submitted that as there is outstanding dues to the tune of Rs. 2,18,09,971/- and that they were left with no other option except to pass the impugned order. After hearing the rival submissions the court concurred with arguments of the counsel for the petitioner and observed that “if there is any outstanding due payable by the petitioner, it is for the respondent bank to work out its remedy in the manner known to and permissible by law before the appropriate forum. Without doing so, resorting to attach the pension amount by way of passing the impugned order is impermissible.” The judge set aside the bank’s order and directed it to permit the petitioner to operate the account without any hindrance.

ORDER

The petitioner is aggrieved against the order of the first respondent dated 13.08.2015 whereby, her Saving Bank Account No.11319810470 dealing only in respect of her pension amount was put
on hold for the purpose of recovery of an outstanding of loan amount.

2. Heard the learned Counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents and perused the materials placed before this Court.

It is the contention of the learned Counsel appearing for the petitioner that the present impugned order passed is in effect attaching the pension amount of the petitioner lying in S.B.Account No.11319810470 by putting such an account on hold, which is impermissible in limb as pension amount cannot be attached or recovered for the purpose of recovery of any outstanding amount payable by time petitioner. In support of such contention, the learned Counsel relied on a decision of the Supreme Court reported in (2009) 1 SCC 376', Radhey Shyam Gupta vs. Punjab National Bank and another.

4. The learned Counsel for the respondents though. admitted. that time said. Saving' Bank .Account
which was put on hold in the impugned order is in respect of the amount only dealing with the pension of the petitioner, has however submitted that as there is a outstanding dues to the tune of Rs.
2,18,09,97l/- as on 03.08.2015, the respondents bank has left ‘with no other option. except to pass the
present impugned order.

5. The question now that arises for consideration before this Court is as to whether the respondent bank is justified in attaching the pension amount of the petitioner by passing the present impugned order for realization of the outstanding dues, as claimed by the respondent bank.

6. It is well settled that attachment of pension amount cannot be made for realization of any outstanding. In this aspect, the above decision of the Apex Court relied on by the learned Counsel
appearing for the petitioner can be usefully quoted, wherein, in paragraph. No.33, time Supreme Court has observed that the pension and gratuity amount should not attached under the provision of the Code of Civil Procedure. Paragraph No.33 reads as follows:-

“33. However, we are also of the ‘view that having regard to proviso (g) to Section 60(1) of the Code, the High Court committed a jurisdictional error in directing that a portion. of time decretal amount; be satisfied frmn the fixed deposit receipts of the appellant held fur the Bank. The High. Court also erred in placing the onus on the appellant to produce time Matador in question for being auctioned for recovery of the decretal dues. In other words, the High Court erred in altering the decree of the trial Court in it revisional jurisdiction, particularly, when the pension and gratuity of the appellant, which had been converted into fixed deposits, could not be attached. under the provisions of the Code of Civil Procedure. The decision inJyothi Chit Fund case has been considerably watered down by later decision which have been indicated in para 22 hereinbefore and it ‘has been held that gratuity payable would not be liable to attachment for satisfaction of a court decree in view of proviso (g) to Section 60(1) of the Code.”

7. Therefore, if there is any outstanding due payable by the petitioner, it is for the respondents bank to work out their remedy to recover the said amount, in the manner known to and permissible by law, before the appropriate forum. Without doing so, resorting' to attach time pension amount by way of passing the impugned order is impermissible.

8. Accordingly, this wait petition is allowed and time impugned order is set aside. Consequently, the respondent bank is directed to permit the petitioner to operate the said Saving Bank Account referred. to above, without any hindrance. No costs. Consequently, connected miscellaneous petition is closed.

7th CPC's Recommendations are detremental to large section of 2 crore familes of Employees.

7TH CENTRAL PAY COMMISSION’S RECOMMENDATIONS ARE DETREMENTAL TO LARGE SECTION OF EMPLOYEES​The Chairman of Seventh Central Pay Commission Justice Ashok Kumar Mathur has since presented voluminous recommendation consisting of 875 pages to Hon’ble Finance Minister. When we go through the recommendations it appears that it anti low paid employees and failed to improve their financial condition, short of suggesting measures for better and encouraging working conditions for them. It is tilted towards higher level officers.
2.​The following important issues on which recommendations are made show the negative approach of the commission towards low level employees, which may be due to anti employee actions ofthe present Government. After independence seven Pay Commissions have been constituted all by Congress or Congress led Governments. NDA Government during the year 2003 was in power but refused to constitute 6th Pay Commission in spite of recommendation of 5th CPC to constitute 6th Pay Commission on 1st Jan, 2003 so that its recommendations could be implemented wef 1st Jan, 2006. This proves beyond doubt that the present BJP Government too is not serious to improve working condition and in financial upgradation of majority of employees. Brief details of main recommendations are:-
Fitment: For fixation of pay effective from 1st Jan, 2016, fitment factor of 2.57 has been proposed for application uniformly for all the employees. It includes a factorof 2.25 is on account of Dearness Allowance neutralisation, assuming that DA would be 125 percent at the time of implementation of the new scale out of 2.57 of fitment formula recommended. The hike will only be 14.29 percent.

The enhancement of pay by 14.29% is very depressing for the employees in past after submission of 5th and 6th Pay Commissions report the minimum hike given was 40%.
(A) It has been our consistent demand to reduce gap between the lowest paid and the highest paid employees from 1:12, recommended by 6th CPC to 1:8 but instead of reducing the gap it has been further increased by the 7th Pay Commission to 1 to 14.
(B) As per para 5.1.27 of the report, “it is proposed that fitment factor of 2.57 is being applied uniformly for all employees.” Whereas at Table 5 : Pay Matrix (Civilian Employees) for level 1 to 5 it is 2.57 and in respect of remaining higher levels except level 13 it ranges between 2.62 to 2.81. It proves that senior officers have been favoured by the Commission in fitment process.
(C) 6th Pay Commission had recommended annual Increment between 3 to 4% of Pay plus Grade Pay whereas Seventh Pay Commission has restricted it to 3% only.
(D) The 7th Pay Commission has proposed to withhold annual increments of those employees who are not able to meet the benchmark either for MACP or regular promotion within first 20 years of service, under the given condition an employee will be left with no option but to leave the job and seek retirement.

(E)Recommendationto withdraw some benefits which employees are already availing:
(i) In the name of parity in the rank of Assistants, between the field staff and headquarter staff grade pay of Rs 4,600 of Asstts of CSS has been placed in the new pay matrix in Level 6, the level corresponds to pre-revised GP of Rs 4200. Similarly the corresponding posts in the Stenographers cadre willalso follow same parity and thus will be deprive of GP of 4600.
(ii) Non-functional selection scale with the GP of 4200 was granted to 30% Upper Division Clerks in CSS and Allied Offices, which is now being withdrawn at the cost of UDCs awaiting grant of NFSS.​
(iii) At present two additional increments are granted at the time of promotion to Under Secy/PPS in CSS/CSSS it is suggested to abolish the benefit.
(F) Recommendation to abolish Allowances, reduce percentage, de-link benefit of DA:
(i) The quantum of percentage based allowances has been reduced, the 6th CPC had doubled it whereas 7th Pay Commission has suggested rationalisation by a factor of 0.8 (para 8.2.3). This will reduce present percentage based allowance for example House Rent Allowance which is at present 30, 20 and 10% in respect of Class X, Y and Z category of cities will come down to 24, 16 and 8% .In the same pattern percentage of other allowances will also be reduced.
(ii) All non-interest bearing Advances viz Festival etc have been abolished.
(ii)Motor Car, Motor Cycle/Scooter/Moped advances have been abolished.
(iii) 52 Allowances presently available to employees will discontinue.
(iv) Identities of 36 allowances have been abolished as separate and proposed to be subsumed with existing or newly introduced allowances.
(v) Transport Allowance which is at present linked with DA, with release of every additional instalment of Dearness Allowance, TA is also proportionally increases, this will be done away.  
(G)Rates of contribution by various levels of employees towards insurance coverage have been exorbitantly increased, the details are:

(H) Process of Cadre Review has been made very difficult.​​​​
​In short Central Government Employees are frustrated and disappointed with the major recommendations of the Commission. It is unfortunate that the employees, who were given 40% hike in their respective pay has now been recommended only 14.29%. This is unjust and humiliating for the beneficiaries.
​We have decided to express our resentment and demand at least 40% hike in the pay of various categories of employees.

In continuations to this Directorate OM.No 41/-1/2011-PAPdated 15th September 2015, on the subject mentioned above and to say that para-2 of the OM dated 15.09.2015 may be read as under:
” Rate of Cycle maintenance allowance are revised @Rs.75/- per month with effect from 01.01.2011 and further revised @ Rs.90/- per month with effect from 01.01.2014. All other terms and conditions for sanctioning of Cycle maintenance allowance will be remain unchanged.’
2. The issues with the concurrence of Integrated Finance wing vide their advice in Dy.No.227/FA/2015/CS dated 03.12.2015.
