Reservation for Dalit Christians.

An individual belonging to Scheduled Tribes may profess any religion and the Castes/ Tribes included in the list of Scheduled Tribes under Article 342 of the Constitution, are entitled for getting the benefits of reservation in services of the Central Government.
The Scheduled Castes converted to Christianity are included in the Central List of Other Backward Classes of some of the States and are entitled to the benefit of the reservation in services of the Central Government. However, the issue of extension of Scheduled Caste status to Scheduled Caste converts to Christianity is presently subjudice in the Hon’ble Supreme Court of India.
This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in written reply to a question by Smt. Pratyusha Rajeshwari Singh in the Lok Sabha today.

            Your kind attention is invited towards both Federation letters dated 07.03.2016 on the subject cited above. In this connection , we would like to bring  to your kind notice  that a JCM Departmental Council  Meeting  was held on 08.12.2015 under  your Chairmanship in which  the issues related  to Pay Commission  were discussed in detail  and it was  decided  that a copy of Memorandum to be submitted  to Implementation Cell  will be  given to Federations, but inspite of  several requests verbal  and in writing  made to you and  Member(Personal), the copy of the same  has not been supplied yet.
            Again it has been informed vide Director, SR & Legal  letter No. 06-04/2015-SR dated 09th March, 2016  that one meeting  will be  held  on 31.03.2016 under your Chairmanship at Directorate on the same  pay Commission  related issues and prior  to it  one meeting will also be held on 28th March 2016 with Director (SR).
            We are very sorry to inform you that in such circumstances we shall not be able to attend the meeting as scheduled. When any decision  is  taken in highest forum and assurances are given  and  if the same is not materialized  and subordinate officers  do not comply with the orders of highest officers  than what’s  the use of holding such meetings again and again. This is merely wastage of time.
            Further we would like  to mention  here that  at the time of submission of Memorandum to Pay Commission  we had requested  several times to supply  the copy of the same  but it was not supplied  but it has been obtained by some retired officials under R.T.I.
            Therefore it is beyond to understand as to what is there which is to be concealed from the unions.
            Even now we have time. Therefore PJCA requests to kindly supply the copy of memorandum submitted to implementation cell and Pay Commission, so that the matter can be discussed in the meeting.
            It is therefore, requested to kindly take necessary action in this regard.

Scheme for providing facilities to the Employees with Disabilities of Department of Personnel and Training:-
Name of the Schemes:-
To provide facilities to the Employees with Disabilities working in Department of Personnel and Training, for ease of doing their day to day office work. The Scheme will come into effect from next financial year i.e. from April, 2016.
Objective of the Scheme:-
The objective of the Scheme is to enable and empower Persons with Disabilities (PwDs) of this Department by providing certain additional facilities to help them discharge their duties more conveniently and effectively.
Facilities under the Scheme:-
The Scheme provides the following facilities to the PwDs:-
• Wheelchairs (Motorised, if required)
• Special furniture
• Hearing aids with battery
• Low vision aids
• Smart Cane
• Special Software/computers
• Braille Signage near lift area, toilets, canteen, fire, exit etc. /Room Numbering/Section Name
• Provision of Beep sound in biometric attendance system
• Induction/lob specific training
Eligibility:-
PwD employees who are serving in DoPT.
Implementation process:-
Employees with disability would be given option to apply for the items mentioned above to the Administration Division through proper channel, which will be examined on case to case basis and decided with the approval of competent authority.

    Subject: Reiteration of the instructions on streamlining the procedure for verification of claims of candidates belonging to Scheduled Castes, Scheduled Tribes and Other Backward Classes for purpose of appointment to posts/services — regarding
Madam/Sir,
I am directed to refer to this Department’s letter no. 36022/1/2007—Estt. (Res.) dated 20.03.2007 addressed to Chief Secretaries of all States/UTs (copy enclosed) regarding streamlining of the process for verification of claims of candidates belonging to Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs). It was also requested to issue instructions to District Magistrates/District Collectors/ Deputy Commissioners to ensure at their own level the veracity of caste certificates so that unscrupulous non-SC/ST/OBC persons are prevented from securing jobs meant for SCs/STs/OBCs by producing false certificates.

2. Owing to difficulties faced by candidates belonging to these reserved communities in various states in securing employment due to delays in obtaining caste certificates, this Department, vide an Office Memorandum of even number dated 08.10.2015, has re-iterated the instructions on providing provisional appointment to such reserved category candidates who are unable to obtain an appropriate caste certificate in time. It has been reiterated therein that where a candidate belonging to a Scheduled Caste, Scheduled Tribe or Other Backward Class is unable to produce a certificate from any of the prescribed authorities, he/she may be appointed provisionally on the basis of whatever prima-facie proof he/she is able to produce in support of his/her claim, subject to his/her furnishing the
prescribed certificate within a reasonable time. If there is genuine difficulty in his/her obtaining a certificate, the appointing authority should itself verify his/her claim through the District Magistrate concerned. A copy of the OM is enclosed for reference and perusal.

3. In order to ensure that the candidates belonging to reserved categories do not face unnecessary problems in obtaining caste certificates, it is requested that instructions issued to the concerned authorities in the light of the aforementioned letter dated 20.03.2007 may be reiterated for information/compliance of all concerned.

4. It is also advised that in order to discourage unscrupulous activities, State Governments/UTs may consider issue of appropriate instructions for initiating disciplinary proceedings against the errant officers who default in timely verification of caste certificates or who issue false certificates.

The below information was given in written reply to a question about the linking between CGHS card and Aadhaar by the Minister of Health and Family Welfare Shri Jagat Prakash Nadda in Lok Sabha on 11th March 2016 as follows…

“Ministry of Health and Family Welfare has issued an Office Memorandum No. Z-15025/11/201-DIR CGHS dated the 10th July 2015 requesting the Ministries/Departments concerned to motivate their employees availing CGHS to link their Aadhaar Numbers with the CGHS database either online themselves through the CGHS portal or through the CMO-in-charge of their dispensary.

Central Government employees/pensioners applying for new CGHS cards/new plastic cards have the option to provide Aadhaar Number for entering the number in CGHS database.

Linking of CGHS beneficiary ID number with Aadhaar number is purely on a voluntary basis.

Linkage of Aadhaar number with CGHS ID will facilitate consolidation of all health-related data bases and enable more convenient access to various E-services in the future.

The periodical meeting of JCM National Council, with the Secretary Pension was held on 10.3.2016 at the the Conference hall of the Department of Personnel and Administrative Reforms, Sardar Patel Bhawan, New Delhi today i.e. 10.3.2016.
After the initial comments from the Secretary Pension and the Secretary Staff Side, the items which had been subjected to discussion in the earlier meeting and the action taken statement thereon were taken up. The following were the issues that came up for discussion in the Action Taken Statement.

1. Abnormal delay in the issue of revised PPO to pre 2006 retirees pensioners/family pensioners. (as per the minutes of the JCM held on 26.02.20125).The following information was given at the meeting:

2.Cashless treatment to CGHS beneficiaries by empanelled private hospitals. The health Ministry officials stated that since the budgetary provisions are made separately for each Ministry it was not possible to ensure cashless treatment to serving employees. The concerned Department or Ministry has to enter into agreement with the hospitals.

3.Finalisation of Family pension cases within a specified period.
It was stated by the official side that the instructions have already been issued. Regarding the complaint from the M.P. Circle of the Postal Department, the matter has been taken up with the concerned authorities on 6.2.2015. The representative of the Postal Department said that the complaint has been attended to and the matter has been settled.

Agenda Items for the meeting:

1. Grant of Gratuity on retirement/death of a Central Govt. NPS subscriber. The representatives of the Pension department said that the Department of Expenditure has given their concurrence for the grant of Gratuity for the NPS subscribers on 8.1.2016. The requisite amendment to the rules, they added were being processed and the consultation with the Law Ministry and the Labour Ministry have already been made. They said that they would expedite the issuance of orders in the matter.

2. Extension of the benefits of full pension to pre-2006 pensioners who had completed more than 20 years of service but less than 33 years. The Staff side said that despite series of judgements in favour of the pensioners, the Government has not yet issued the orders. Recently the Nagpur Tribunal has issued a contempt notice to the Government. They also alleged that the pensioners are being dragged to litigation. The Representatives of the Pension Department informed that the Department of Expenditure had not agreed to extend the benefit generally to all which has resulted in filing appeal. The representative of the Department of Expenditure stated that in the light of the view of the Department of legal affairs, the matter would be re-examined.

3. Delay in the finalisation of Family pension cases by the PCDA (Pension) Allahabad. In response to the complaint the representative of the Defence Ministry informed that only in a few cases, the finalisation has been delayed due to the documentation difficulties. They assured to sort out the matter.

4. Grant of modifed parity to all those who retired prior to 1.1.2006 with reference to the upgraded post. The Staff Side stated that the Department of Pension has taken a very narrow view of the matter and the cases are dragged to the courts of law. The very spirit of the recommendation of the 5th CPC to bring about atleast modified parity if not full parity has not been appreciated by the Govt. The issue was discussed at length. The official side pointed out the decisions of the Court in favour of the position taken by the Government in the case of K.S. Krishnaswany in CANO. 3174/3006, which has been upheld by the Honourable Gujarat High Court. In reply the Staff Side pointed out that the said decisions quoted by the official side had come about due to the phrase employed while issuing the original order viz. corresponding replacement scale. After some discussions, the Chairman agreed to look into the matter afresh and revisit the order of the Department of Pension in the matter.

5.The meeting also discussed the difficulties of Pensioners during the hearing of Pension Adalats. The Staff Side pointed out the need to engage some knowledgeable person to assistant the complainants. The official side said that there had been no prohibition in the matter. The Petitioners are entitled to seek the assistance of another pensioner in presenting his case. If specific complaint of denial of this facility is brought to their notice, the Pension Department will issue the necessary instruction in the matter.

Railway, Central staff seek better deal

A massive lunch-hour demonstration before the Rail Nilayam here on Friday saw over 2,000 employees of the South Central Railway and other Central Government organisations coming together to showcase their demands that include among others, opposition to privatisation moves, better pay and working conditions. Following a call from the National Joint Council of Action (NJCA), similar demonstrations were organised across the country before Zonal offices to show their strength, said NJCA chairman and general secretary of the National Federation of Indian Railwaymen, M. Raghavaiah, while addressing the gathering. He said an estimated 42 lakh Central Government employees would go on an indefinite strike from July 11, notice for which would be served on June 9. The demands include minimum pay of Rs. 26,000 as against the Rs. 18,000 offered. The minimum pay, employees alleged, was fixed taking into consideration the average price of Labour Bureau, instead of actual prices in the market. For example, the employees were told that cost of rice was taken as Rs. 24 a kilo, while the price for a metre of cloth for the family was taken as Rs. 141. Others who addressed the gathering include chairman and general secretary of the Joint Council of Action, G. Prabhakar Andrew and Ch. Sankara Rao, respectively.

Delhi Postal Circle gets National Award for enhancing electoral participation by Election Commission of India

 With the aim to give final opportunity to cast vote using postal ballots through a dedicated set up at Post offices, on 8.2.2015, at the behest of Chief Election Officer, Delhi, the Department of Posts, Delhi Circle made a plan within few hours for exclusive arrangements with regard to collection and delivery of Postal ballots. The plan envisaged: a)Round the clock collection of Postal ballots on 09.02.2015 [upto 0600 hrs. 10.02.2015] at 9 identified Post Offices b) Exclusive drive for collecting ballots posted in more than 1300 letter boxes across Delhi by ensuring collection [clearance] from Letter Boxes 'thrice' on 9.2.2015. c) Exclusive logistical arrangement for delivery of all the postal ballots by deploying dedicated mail vehicles on the morning of 10.2.2015. For this purpose, It provided, for the first time in India, an unprecedented opportunity to electors to cast vote using postal ballots up to two hours before start of counting of votes. The 24 hour operational arrangement at Post Offices aided by dedicated logistical support for delivery resulted in a seamless and transparent system of collection and timely delivery of postal ballots. Entire arrangement was well coordinated and monitored and no complaint was received on this accord. Thus, for the best services rendered by the Department of Posts, Delhi Postal Circle was honored with the National Award by the President of India on 25th January 2016 for Enhancing the Electoral Participation under Government Organization/ PSU category.

Govt has the "absolute right" to fire, if necessary in the public interest, employee who joined service before the age of 35 and has crossed the age of 50 or 55

New Delhi: Employees of autonomous institutions like central universities and AIIMS will come under government scanner now which will keep track of their performance.

Under Fundamental Rule 56(J), the government has the "absolute right" to retire, if necessary in the public interest, any Group A and B employee who joined service before the age of 35 and has crossed the age of 50.

Also, a Group C government servant, who has crossed the age of 55, can be retired prematurely under the rule.

The Department of Personnel and Training (DoPT) today asked all administrative ministries to ensure that autonomous institutions have adopted the provisions of FR 56 (j) and that they are strictly followed.

In case where the autonomous institutions have similar provisions in their rule books, the administrative ministry may ensure that they are followed in letter and spirit, it said.

In case there is no such provisions exist in regulations governing their working, the administrative ministry may ensure that the action is taken to put in place such rules as may be necessary, the DoPT said in a communique to all central government secretaries.

There number of autonomous institutions and bodies under the administrative control of central government that include Aligarh Muslim University (AMU) and All India Institute of Medical Sciences (AIIMS), as per a government directory.

The Centre is conducting review of its employees working in ministries. While addressing a conference here in November last year, Prime Minister Narendra Modi had said 45 senior officers have either been removed or faced pension cuts for "unsatisfactory performance and delivery in public service". 

Meeting with Chairman, GDS Committee.

On 11-03-2016, the President FNPO& SGFNPO met the Chairman & Secretary GDS Committee at their office. Informally we discussed GDS issues in General. The chairman & secretary of the committee are positive and they are keen to the settle the issues of GDS within their boundary the committee may hold meeting with Federations/ Unions in the 3rd week of April2016 onwards. The Chairman categorically assured that the committee would submit its report within prescribed period. Let us hope they will recommend favorable suggestions to the Government for the betterment of GDS.

On 10-03-2016 , the President FNPO& SGFNPO met Member planning & Member HRD outcome of the meeting will be published in the Sentinel.
