Govt May Implement Seventh Pay Commission Report From April 2016

New Delhi: The Seventh Pay Commission drafted in to make a new pay structure for the 30 lakh Central government employees would not be able to submit its report in August this year, the Commission is likely to seek extension till October.

The reports of Seventh Pay Commission will be implicated from April next year as Finance Minister Arun Jaitley said in the Parliament on February 27, “The 7th Pay Commission impact may have to be absorbed in 2016-17.”

Finance Minister Arun Jaitley said above statement in his pre-budget speech. His statement indicates that the government may implement Seventh Pay Commission report from April 2016.

The UPA government formed the Seventh Pay Commission on 28 February 2014 under chairman justice Ashok Kumar Mathur with a timeline of 18 months to make its recommendations. According to present position, the commission will take at least 20-24 months.

However, the Sixth Pay Commission had submitted its report within 18 months.

As a result of the recommendations of the Sixth Pay Commission, pay and allowances of the central government employees more than doubled as per Fourteenth Finance Commission estimates.

As such, the central government employees are expected to get 100 percent salary hike under the recommendations of the Seventh Pay Commission.

Issues like inflation, the government’s financial position and salary structure of government employees in other countries would also be considered as parts of pay panel recommendations.

The Fourteenth Finance Commission asked the pay panel to link the pay with productivity, which will be the biggest hurdle for central government employees to be got over to get salary hike.

It is interesting to note that the earlier governments never accepted to link the pay with productivity.

No Curtailing of Public Holidays
As per the existing policy, the Central Government Administrative Offices observe up to 17 holidays in a year on specified occasions which consist of 3 National Holidays (on 26th January, 15th August and 2nd October) and 14 other holidays to celebrate festivals of different regions/religion in a diverse country like India.

At present there is no proposal under consideration of the Government to curtail the public holidays for government employees.
This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri S. Thangavelu in the Rajya Sabha today.

Sub : Relaxation in minimum education qualification norms for recruitment of sportspersons in Group-C against sports quota, both through Talent Scouting and Open Advertisement, against the Non-Technical Popular Categories.
Ref.: Railway Board’s letter No.E(NG)II/2-12/RR-1/16/Pt.A dated 17.12.2014 (RBE No- 145/2014).

In the aforesaid letter it has been stipulated that the minimum educational qualification for recruitment to the post of Office Clerk, Account Clerk, Ticket Collector, Commercial Clerk and Train Clerk under Non-Technical Popular Categories (NTPC), should be 12th (+2 Stage) pass or equivalent, with not less than 50% marks in the aggregate.
2. The question has been raised to whether in the case of sportsperson to be appointed against the post mentioned in pre-para, has to possess minimum of 50% marks in 12th (+2 Stage). The matter has been considered and it has been decided that for recruitment to said posts against sports quota, both through Talent Scouting and Open Advertisement, the candidate having minimum a pass certificate in 12th Class (+2 Stage) need not be insisted upon and candidates possessing a pass certificate in 12th class (+2 Stage), may also be considered for appointment, provided the other prescribed conditions are satisfied in their case.
3. This issues with approval of Board (MS).

LTC to SAARC countries

LTC to Government Employees to visit SAARC countries under consideration
A proposal to provide Leave Travel Concession (LTC) to Government employees to visit some SAARC countries is in its initial stage of consideration. The details are yet to be finalized.
The purpose behind the proposal is to enhance people-to-people contact and bilateral ties in the SAARC region through increase in tourism in the region.
As per the Government’s order dated 26.09.2014, the Government has extended the facility of conversion of home town LTC to visit the states in the North East Region, Jammu & Kashmir and the UT of Andaman & Nicobar Islands for a period of two years up to 25.09.2016. This facility was first introduced in the year 2008.
Presently, no other proposal is under consideration for including more places under the conversion of Home Town LTC to anywhere in the country.
This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri M. Raja Mohan Reddy in the Lok Sabha. 

Clarification on MACP Scheme

Employees joining in Grade Pay of Rs.4600 on direct recruitment

Subject: Grant of financial upgradation under MACP Scheme – Clarification reg.
Ref: ECR’s letter No.E/205(A)/O/ECR/HJP, dated 11.07.2014
In context of E.C.Railway’s letter under reference, it is stated that the matter has been examined and it is clarified that:-
(a) The employees joining a post in Grade Pay of Rs.4600, on direct recruitment basis may be considered for grant of financial upgradation in Grade Pay of Rs.4800, Rs.5400 of PB-2 and Rs.5400 of PB-3, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.
(b) Similarly, the employees joining a post in Grade Pay of Rs.4200, on direct recruitment basis may be considered for grant of financial upgradation in Grade Pay of Rs.4600, Rs.4800 and Rs.5400 of PB-2, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.
(c) Accordingly, the employees joining a post in Grade Pay of Rs.2800, on direct recruitment basis may be considered for grant of financial upgradation in Grade Pay of Rs.4200, Rs.4600 and Rs.4800 of PB-2, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.

2. Further, the grant of financial upgradation under MACP Scheme is subject to fulfilment of terms and conditions contained in Board’s letter dt. 10.06.2009 (RBE No.101/2009) and clarifications issued in context thereof and the same may please be ensured while considering cases for financial upgradation under MACP Scheme.

Sub : Verification of Membership – 2015 – our suggestion.
 
Kindly recall our discussion on the subject.
My Federation submits the following for your consideration and for doing the needful.
1. While conducting verification of Membership during 2011, my Federation had demanded actual
staff strength in the Division/unit by cadre-wise. For Example, in the case of P.O., P.AS., LSG, HSG II, HSG I, Postmen, Group D and GDS (adhoc GDS and officials working in GDS vacant places should not be included). In the case of RMS, S.As, LSG, HSG II, HSG I, Mail Guards & MTS. Part Time Casual Labourers and temporary Status Casual Labourers should not be included. In the case of Circle office, officials working on deputation and officials working in electrical wing should not be included. In the case of Civil Wing, officials working on deputation should not be included. In short actual staff strength of each cadre mentioned above should be kept ready before starting the verification of membership for the present year. Moreover candidates recruited and undergoing training should not be included in the working strength. Before starting the verification process, staff strength for each cadre should be kept ready in the Directorate. There should be cross-check of the figures furnished by the Circles with the figures already available in the Directorate after verification. The Heads of Circles should give a certificate for the correctness of the figures specifically stating that officials working in vacant posts adhoc posts have been excluded from the actual staff strength
Heads of Circles should ensure that Deputationists Casual Labourers, contingent staff and trainees have not exercised their options. Responsibility should be fixed on the erring officers.
Last time, after verification process when we obtained staff strength under RTI, it was not tallied in
respect of figures of any cadre furnished by the Circles. Particularly, GDS and staff strength of Circle office. The Directorate should ensure this time that staff strength of every cadre furnished by the Circles should be one and the same before and after verification.
2. While conducting verification of membership process in Railways and BSNL, they follow secret
ballot system. But this is not accepted by the Dept. of Posts stating that it is not possible in the Postal
Department. Therefore my Federation suggests the following feasible election process in the Divisional level. If this process is followed in true spirit, this will pave way to find out real membership of each union cadre-wise.
OPTION 1
i. A ballot paper may be provided to the official to opt for a single union by voting against the symbol. (Before election, symbols may be allotted to each Federation).
ii. Casting of vote may be conducted in each H.O. in respect of Group ‘C’ officials and at Sub-Divisional level for GDS.
iii. The Regional office may nominate a Gazetted officer to supervise the election and counting.
iv. If any deviation is found later in the Division / Sub –Division, the responsibility should be fixed on the erring officer later and such officer should be punished under departmental disciplinary proceedings.
v. Each union may be authorized to nominate an agent in voting booth to ensure that the actual officials have cast vote.
vi. While casting vote each voter should be asked to produce ID card with photo issued by the
Department.
vii. Before conducting election, six weeks time should be given to the Federation.
OPTION – 2
i. A single letter of authorization signed by the Divisional Head only may be send alongwith one selfaddressed service cover to all the officials by registered post with acknowledgment. These Regd.
Letters should not be either re-directed or delivered at the office other than the designation.
ii. The officials may write the name of the union which he opts in his own handwriting and affix his
signature on the ballot paper with designation.
iii. Letter of authorization may be returned to the Divisional Head by registered post using self-addressed cover received from the Head of the Division.
iv. Covers received by the Divisional Head should be opened in the presence of representatives of the
Federation.
v. There is no need to attest the authorisation letter by the concerned union secretary.
vi. While counting authorization letter the Divisional Heads should be present.
OTHER SUGGESTIONS
1. In the system which is in vogue is permitted, to enroll membership only in the month of April. This has resulted in promotes and newly recruited members are deprived to became a member of an union.
Therefore it is suggested that one authorization letter may be sent to promotes / trainees to opt for
membership of union of their choice.
2. Authorisation letter may be sent to the Divisional Head and it should checked in the presence of union representative and the Divisional Head may order recovery of subscription of the basis of choice of the promote/trainee.
3. Officials may be allowed to withdraw their membership at any time by giving a letter direct to the Head of the Division. However, change of union may be allowed in the month of April each year.
My Federation hopes the Directorate will consider the views with an open mind in the interest of
conducting free and fair verification.

1) Grant of Family Pension and gratuity to the family of an employee,pensioner reported missing

Subject: – Grant of Family Pension and gratuity to the eligible member of the family of an employee/pensioner/ family pensioner reported missing-consolidated instructions regarding.
Reference: – This office Circular No. 498 dated 08.08.2013.
A copy of Govt. of India, Ministry of Defence letter No 1(1)/2010-D(Pension/Policy) dated 23.12.2014 is reproduced wherein it has now been decided to issue consolidated instructions in supersession of previous instructions by various Govt. letters as mentioned in Para-1 of ibid Govt. letter regarding grant of family pension to the eligible members of family of the Armed Forces Personnel/Pensioner/Family pensioner reported missing and whose whereabouts are not known. It includes those kidnapped by insurgents /terrorists but does not include those who disappear after committing frauds/ crime/desertion etc.
2. In the case of a missing Armed Forces Personnel/ Pensioner/Family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of DSOP/AFPP fund and gratuity (whatever has not already been received) to the IHQ / Record Office concerned, where the officers and JCOs/ORs in Army and equivalent in Navy and Air Force, had last served, six month after lodging of police report. The family pension and/or retirement gratuity may be sanctioned by the respective Pension Sanctioning Authorities (PSAs) after observing the following formalities:-
(i) The family must lodge a report with the concerned Police station and obtain a report from the police that the Armed Forces Personnel/ Pensioner/ Family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary/General Diary Entry, filed by the Police authorities concerned, as per the practice prevalent in the state/ UT.
(ii) An Indemnity Bond should be taken from the nominee/dependents of the Armed Forces Personnel/ Pensioner /Family pensioner that all the payments will be adjusted against the payments due to the Armed Forces Personnel/Pensioner /Family pensioner in case she/he appears on the scene and makes any claim.
3. In the case of a missing Armed Forces Personnel, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date upto which pay and allowances have been paid or the date of the police report, whichever is later. In the case of a missing pensioner/family pensioner, it will accrue from the date of the police report or from the date immediately succeeding the date till which pension/family pension had been paid, whichever is later.
4. The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.
5- Before sanctioning the payment of gratuity, Service HQrs/ Record Office will assess all Government dues outstanding against the employee/pensioner and affect their recovery in accordance with instruction in force.
6. The amount of salary due, leave encashment due and the amount of DSOP/AFPP fund will be paid to the family in the first instance as per the nominations made by the Armed Forces Personnel/ Pensioner on filing of a Police report and submission of an indemnity bond as indicated above.
7- The benefits to be sanctioned to the family/nominee of the missing Armed Forces Personnel/ Pensioner will be based on and regulated by the emoluments drawn by him/her as on the last date he/she was on duty including authorised periods of leave.
8. Formats of separate Indemnity Bonds to be used in the case of missing Armed Forces Personnel, missing pensioners and missing family pensioners are available at the official website of PCDA (Pensions) Allahabad i.e. www.pcdapensionnic.in.

Sub:- Revision of pension of pre-2006 pensioners – reg.
The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide Department of Pension & Pensioners’ Welfare’s OM dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.
2. The Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in its common order dated 1.11.2011 in four petitions [OA No.655/2010, 306/2010, 50712010 and 3079/2009] directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension with reference to the fitment table applicable for revision of pay of serving employees.
3. A large number of representations from pre-2006 pensioners are being received by the Department of Pension & Pensioners’ Welfare for extension of benefits similar to what had been allowed in case of OA No.655/2010 by CAT, Principal Bench, New Delhi.
4. In this context, it is informed that four Writ Petitions were filed in the High Court of Delhi challenging the order dated 1.11.2011 of Hon’ble CAT in four OAs. These petitions were dismissed on 29.4.2013. Subsequently, four SLPs were filed in the Hon’ble Supreme Court over a period of time against the said order of the Hon’ble High Court. Of the four SLPs, the one pertaining to Central Government SAG (S-29) Pensioners’ Association which was first in the series of said SLPs, has since been dismissed by the Hon’ble Supreme Court on 29.7.2013. As the Review Curative Petition against the said order dated 29.7.2013 also failed, the Government of India decided to comply with the order by extending the requisite benefits to the parties involved in the said SLP. As regards the other three SLPs (Nos.36148-50/2013), Hon’ble Supreme Court in its order dated 19.11.2013 issued notice and made the following observation: .
“Learned Counsel for the respondent submits that during the pendency of these petitions the respondent-writ petitioners shall not precipitate the matter by filing contempt proceedings either before the High Court or before the Tribunal. That statement is recorded. “
5. Thus the issue of revision of pension of pre-2006 pensioners w.e.f. 1.1.2006 as covered under SLP Nos. 36148-50/2013 in the Apex Court which have been tagged with Civil Appeal No.8875-76/2011 filed by Ministry of Defence in a similar matter is subjudice.

Subject: Implementation of Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011 in the matter of Shri T.S.R.Subramanian & Others vs. UOI & Others — Parliament Assurance in Rajya Sabha Unstarred Q. No.988, answered on 17.07.2014, on ‘Amendment in Rule 3(3) of All India Service (Conduct) Rules’ — regarding.
The undersigned is directed to state that in reply to part (b) of the above Rajya Sabha Unstarred Q. No. 988 for 17/07/2014, the Parliament was, inter-alia, informed that ‘the directions of the Hon’ble Supreme Court in the PIL filed by Shri T.S.R. Subramanian and others were brought to the notice of the various Ministries / Departments who are the Cadre Controlling Authorities of the Central Civil Services for compliance’. This part of the reply has been treated as an Assurance.
2. It may please be recalled that, following the Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011, the Ministries / Departments were requested to take steps for implementation of the judgement. In view of the above Parliament Assurance, all Ministries / Departments are requested to please send a line in confirmation of the implementation of the above judgement in respect of the Cadre(s) under their administrative control by 20.03.2015 so that the Assurance can be fulfilled. The Cadre(s) under the administrative control may also please be indicated for records.
3. The Ministries / Departments, which are not Cadre Controlling Authorities for any cadre, may also kindly send a communication in this regard for the records of this Department.
