                  கடந்த 2 1/2 ஆண்டுகளுக்கு மேலாக சென்னை உயர்நீதிமன்றத்தில் நடைபெற்று வந்த நமது மாநில சங்க நிர்வாகிகள் தேர்வு சம்பந்தமான வழக்கு WP No.14675 of 2014 கடந்த 18.08.2016அன்று முடித்து வைக்கபட்டுள்ளது அனைவரும் அறிந்ததே.
அதன் நகல் நேற்று முறைப்படி வழங்கப்பட்டது.
அதில்  சென்னை உயர்நீதிமன்றத்தில் நமது General Secretary மற்றும் CPMG தரப்பினர் மறுப்பு எதுவும் தெரிவிக்காதபடியால் வழக்கு தொடர்ந்த திரு விநாயகம் அவர்கள் தரப்பு கேட்டு கொண்டபடி தேசிய சங்க சட்ட திட்டங்களுக்கு உட்பட்டு நமது தமிழக CPMG அவர்கள் புதிய நிர்வாகிகள் தேர்வு செய்திட அறிவிப்பு வெளியிட்டு விரைந்து நடவடிக்கை எடுத்திட பணித்துள்ளது.

No commitment from the Chairman and Official Side of the Committee to examine the recommendations of 7th CPC regarding Allowances  Details of the second meeting on allowances held on 1.9.2016 
The meeting of the Committee was held on 1st September, 2016 at Room No. 72, North Block, New Delhi under the Chairmanship of Finance Secretary and Secretary (Expr) to discuss on 7th CPC allowances. The JCM (Staff Side) Standing Committee Members have participated in the meeting. All the Standing Committee Members (Staff Side) expressed their serious disappointment over non-fulfillment of the assurance given by the Finance Ministry on 6th July 2016 for setting up High Level Committee to examine 7th CPC issues mainly – Minimum Wage and Multiplying Factor.

The Leader Staff Side & General Secretary, NFIR Shri M. Raghavaiah has explained to the Finance Secretary, the discussions held between JCM (Staff Side) Leaders & Senior Ministers namely S/Shri Rajnath Singh, Arun Jaitley, Suresh Prabhu and Shri Manoj Sinha on the night of 30th June, 2016 and subsequent meeting held on 6th July, 2016 with Union Home Minister. He further explained that an assurance was given to appoint a High Level Committee to examine the issues relating to Minimum Wage, Multiplying Factor and other allied issues and accordingly Finance Ministry had issued statement on the night of 06th July, 2016 that a High Level Committee will be constituted. Pursuant to this assurance, the Strike action was deferred by the NJCA/JCM (Staff Side). He conveyed that the non-fulfillment of assurance is causing disappointment among employees. He requested the Chairman of the meeting to take initiative for ensuring that the assurance given is fulfilled.

He also expressed disappointment over non-holding of National Council (JCM) meetings since the last six years, resulting accumulation of grievances.

On the “Allowances”, he urged upon the 7th Chairman to consider granting 30%, 20% & 10% of 7th CPC Pay, for the staff working in X, Y & Z Cities/Towns w.e.f. 01/01/2016. He also contended that the date of effect of the Allowances should be January 1, 2016.

Mr. Raghavaiah has also highlighted the 7th CPC aberrations on Transport Allowance and requested to take action for rectification. He said that Fixed Medical Allowance be revised upwardly. He invited the special attention of the Finance Secretary to Para 8.2.5 of the 7th CPC recommendation which is retrograde and needed to be rejected as the same would cause harm to staff. He cited the case of PCO Allowance, Special Allowance for announcing duties, Special Incentive allowance etc., admissible in railways which are required to be continued and hiked

President/NFIR Shri Guman Singh, Working President Shri R. P. Bhatnagar, Vice President Shri K.S. Murty also spoke and stressed upon the need to continue the existing Allowances like Break Down Allowance in Railways. They also expressed serious disappointment over non-revision of Minimum Wage and Multiplying Factor.

While there has been no commitment from the Chairman and Official Side of the Committee, the Finance Secretary however stated that further meetings will be held and in the meantime the JCM (Staff Side) may list out common issues and send the same to the Joint Secretary (Imp) and equally Departmental specified issues be sent through the respective Administrative Ministries for examination.

Sub: Brief of the meeting held today between the Government of India and the National Council (JCM) (Staff Side)

The Government of India has constituted a committee, under the Chairmanship of Addl. Secretary(Exp.) with J.S.(Pers.), JS(Estt.) and JS(Imp.) as members, to deal with the pending issues of our memorandum, submitted to the Empowered Committee, of which prominent are “Minimum Wage and Multiplying Factor”.

The first meeting of the said committee with the National Council(JCM) Staff Side was held today, i.e. 30th August, 2016, which remained almost introductory. Apart from the Official Side members, Shri M. Raghaviah, Shri M.S. Raja and I myself(from the Staff Side JCM) attended the said meeting.

We raised vehemently the issues of “Minimum Wage and Multiplying Formula” and made them very clear that; the VII CPC has accepted Dr. Aykroyd Formula for fixing Minimum Wage, but has not implemented the said formula in full sense, so, that is not acceptable to the Staff Side(JCM), therefore, Minimum Wage from Rs.18000 must be enhanced and accordingly Fitment Formula should also be changed.

It was agreed by the committee that, since we are again meeting on 1st September, 2016 with the Committee on Allowances, the next meeting of the said committee will be fixed in consultation with the Staff Side(JCM).

Thereafter, we also met the Cabinet Secretary(Government of India) and there also we shown our anguish about the inordinate delay in resolving those issues which were agreed to. The Cabinet Secretary said that, orders for the gratuity have been issued for the NPS covered employees, and orders for the PLB and arrears have also been issued. Many of the issues raised by the Staff Side(JCM) have been accepted and implemented and the remaining issues would also be pursued and settled.

Doubts and clarifications on the strike day.

Our Federation receiving calls from many cadres’ genuine doubts are clarified here.
 1) Why FNPO is participating strike?
 It is already published in our website and Federal sentinel August, 2016.
 2) Why FNPO participating one day strike?
 Situations are changed further this is  central trade unions call we have to obey as sincere soldiers.
 3) When there is a 24 hours office at what time strike start?
 It is clear strike starts12 at mid night on 01/09/2016.
 4) Circle /Regional& Divisional offices are holidays on Saturday and Sunday is there any chance the Department construes this point?
 Members who don’t want to participate strike created this issue. It is very clear strike is for only one day on 2nd September. Notice issued by central Trade unions accordingly and followed by us don’t create confusion.
 Do Participate in the 2nd September strike and feel proud. Cowards only run away from the battle not by sincere soldiers.

Sept 2 nationwide strike to be bigger than last year’s

As many as 10 central trade unions will go ahead with the general strike on Friday saying the government gave no heed to their 12-point charter of demands and is continuing with unilateral labour reforms.
CTUs claimed that over 15 crore workers are likely to participate in the strike and it will be bigger than the one held last year as members of BMS will also support them.
RSS-affiliated Bhartiya Mazdoor Sangh (BMS) is the only major trade union which has opted out of strike – like last year – which was also held on September 2, in view of the assurances given by the government.
Some leaders of BMS have decided not to go on strike. But its state units would participate in the strike. Workers will give a befitting reply to the dubious activities inspired by the government,” CITU General Secretary Tapen Sen said here in a joint press conference by 10 CTUs here.
CTUs reiterate the call for countrywide general strike on September 2 against the “anti-worker and anti-people policies” of the government and in view of its “utterly unresponsive and undemocratic attitude”, Sen added.
All India Trade Union Congress (AITUC) Secretary Amarjeet Kaur said the unions view the announcements made by Ministers’ panel, headed by Finance Minister Arun Jaitley, as eyewash.
“It is like cheating the people,” she said, adding that this time the number will be bigger than 15 crore who participated in the general strike last year and more than 10 states will have bandh-like situation.
Strike is going to be complete in industrial sectors such as transport, financial, power, coal, textile, port and dock, automobile, steel, oil, defence production, scheme, education and Central and State government employees, Kaur added.
Referring to BMS decision not to participate in the strike, Kaur said: “Government has not had a single meeting with the CTUs in over a year and is talking to those (BMS) who have not given a strike notice.”
Indian National Trade Union Congress (INTUC) Vice President Ashok Singh said: “Prime Minister Narendra Modi said his fight is with poverty, but it seems his fight is with the poor in this country. The government’s decision are totally pro-capitalist.”
CTUs expressed dismay over “utterly negative” attitude of the government on basic demands of workers on minimum wages as per consensus formulation of Indian Labour Conference, on universal social security including pension for all workers including those in unorganised sector, among others.
They added that government is dragging its feet over the mass scale contractorisation of permanent and perennial work.
Attacking the government’s initiatives on labour reforms, the unions said: “All these proactive initiatives militate against the basic interests and rights of the working people. Even the non-striking CTU (BMS) also officially recorded its opposition.”

7th Pay Commission Latest News – Three important demands of NJCA which are likely to be discussed in the 7th CPC Meeting to be held on 1st September 2016

To discuss the anomalies related to the implementation of 7th Pay Commission, the high-powered Committee of Secretaries formed by Centre has invited leading employee union National Joint Council of Action (NJCA) for a meeting on September 1.
NJCA would be represented at the meet by it’s current convenor Shiv Gopal Mishra. Aggrieved Central Government employees pin their final hope in the outcome of the Sept 1 meeting. If the Government constituted body fails to incorporate their demand, a large section of the organized workforce would call a strike.
Although, it has not been revealed whether the Committee of Secretaries would attempt to negotiate the demands at the upcoming meet, it has been assured that grievances of the employees, as raised by the Unions, would be noted down in a detailed manner by the Secretaries. Representing NJCA, Shiv Gopal Mishra is expected to show an uncompromising stand on at least the following three demands: 1) Hike in Fixed Medical Allowance (FMA),  2) Revision in the hike of minimum salary, 3) Availability of ‘Option 1′ for pensioners.
Hike in Fixed Medical Allowance (FMA): Central Government employees had demanded the 7th Pay panel led by Justice (retd) AK Mathur to raise FMA from current Rs 500 per month to Rs 2,000 per month. The demand appears legit to the employee unions as even many of the private sector companies are paying Rs 1200 to Rs 1800 per month as medical allowance to lower-middle level employees.
Revision of hike in minimum salary: NJCA, along with other employee unions have raised the demand to restructure the hike in minimum salary using 3.68 fitment factor. The entry-level pay as per 6th Pay Commission was Rs 7,000. The AK Mathur-led panel increased the minimum salary by multiplying with 2.57 fitment factor. This increased the salary to Rs 18,000. If the 3.68 fitment factor would be used, the minimum salary would be restructured to Rs 26,000.
Availability of ‘Option 1′: The All India Postal & RMS Pensioners Association (AIPRPA) has demanded the Government to enable Option 1 for hiking their pensions. According to Option 1, the hiked pensions would be fixed in the pay matrix on basis of the grade and and pay band in which they were enrolled at the time of retirement. According to the second option, the pay panel has recommended the pension hike by using 2.57 fitment factor. The second option would multiply their existing pensions by 2.57.
Despite Shiv Gopal Mishra appearing as the leading voice among those who are articulating the cause of aggrieved employees, a number of central government employees have raised doubts against him. His decision to roll back the July 11 mass strike, which was expected to evoke the participation of 33 lakh central government employees, has not gone down well with those among the dissidents. Several employees have straightaway asserted that if the government fails to pay heed to at least the above three demands, a rejuvenated call for strike should be made.

Government is issuing orders one by one last few days considering our demands to break the strike on 2nd September 2016. But our important demands of Minimum wage, Stoppage of contractorisation in permanent/perennial work and No unilateral amendment to Labour laws is not considered by the Government.



The following favorable orders were issued only after seeing our strike notice. 

1) Extension of benefit of Retirement Gratuity and Death Gratuity to the Central Government Employees covered by new Defined Contribution Pension System (National Pension System) – 

2) Grant of Productivity Linked Bonus (PLB) and non-Productivity Linked Bonus (Ad-hoc bonus) in case of Central Government employees for the accounting year 2014-15- enhancement of the calculation ceiling- 



 If you want self respect from your officers go strike on 2nd September.

We are not against the Government. We are fighting against the principles of the Government

We are not worried who is ruling country our concern is who is protecting the workers interest.

We are losing our rights one by one which got by our senior leaders by sacrificing themselves.

We should not be blamed by our future generations.

Trade unions refuse to call off 2 September strike

Trade unions refuse to call off 2 September strike Trade unions reject the request to call off the strike saying that the government has failed to address their 12-point charter of demands 

Senior Union ministers on Saturday held extensive talks after trade unions said no to the government’s request to call off their proposed nationwide general strike on 2 September.


Labour minister Bandaru Dattatreya had urged the central trade unions  on Friday to reconsider their decision to go on strike. However, trade unions on Saturday rejected the request saying that the government has failed to address their 12-point charter of demands. Replying to Dattatreya’s letter, Trade Unions said the status report on the demands is “almost the same as that you circulated exactly one year ago, in the joint meeting with the CTUs held on August 26-27, on the eve of the general strike in 2015”. 
The unions attacked the government saying it is “equally unfortunate” that no concrete measures have been spelt on the issue of price control of essential commodities, statutorily fixing the minimum wage as per norms and social security. Meanwhile, power and coal minister Piyush Goyal and Dattatreya on Saturday held extensive consultations and meetings with senior labour ministry officials over the proposed countrywide strike, sources said. 
Both Goyal and Dattatreya are part of the five-member ministers’ panel on labour issues, which is chaired by finance minister Arun Jaitley, to talk to the CTUs over the 12-point charter of demands. The panel has recently held two-rounds of discussions with Rashtriya Swayamsevak Sangh-affiliate Bhartiya Mazdoor Sangh (BMS) on 16 August and 24 August, which has also been “severely criticised” by other unions for holding such “exclusive discussions”. 
The panel last met all the unions on 26-27 August 2015. The unions had requested Dattaterya on 18 July this year to hold a meeting with the ministers’ panel to pay heed to their point of view, but no such meeting was convened. 

In anticipation of some positive response on the charter of demands, BMS is holding back its decision to join the stir on 2 September. Last year, BMS had opted out of ‘Bharat Bandh’ (2 September 2015) in view of the government’s assurances to work on nine out of the 12 demands. 
CITU general secretary Tapan Sen told PTI that there is no question of calling back the strike. Similarly, Indian National Trade Union Congress (INTUC) vice president Ashok Singh also said that the decision to go ahead with strike stands. AITUC said, “AITUC along with other CTUs finds it difficult to accept your (government’s) request for reconsideration of call of protest strike on September 2, 2016. The decision to go on strike stands.”

Government may relax ‘creamy layer’ norms for OBC reservation

The Social Justice Ministry is working on a proposal to raise the annual income ceiling of OBCs to Rs 8 lakh, according to official sources.

                With a large number of vacancies in government jobs meant for Other Backward Classes (OBCs) remaining unfilled for want of candidates, the government is mulling relaxing the ‘creamy layer’ criterion by raising the income ceiling to Rs 8 lakh annually.
Almost 27 per cent of seats in government jobs and educational institutions are reserved for OBCs provided the annual income of the family is up to Rs 6 lakh and those who earn above that are referred to as the ‘creamy layer’ and are not eligible for reservation. Raising the ceiling would result in a larger pool of candidates eligible for government jobs and seats in educational institutions.
        The Social Justice Ministry is working on a proposal to raise the annual income ceiling of OBCs to Rs 8 lakh, according to official sources. A Cabinet note is likely to be moved in this regard soon, they said. When contacted National Comission for Backward Classes (NCBC) Member Ashok Saini told media that the panel had recommended more than doubling the income ceiling to Rs 15 lakh.

          “Even two decades after reservation (was introduced), out of 27 per allocated quota, it has been seen that only 12-15 per get utilised. As per our analysis, the major reason behind this is the ceiling on annual income,” Saini said.
            As per Mandal Comission report, in 1980 OBCs constituted 52 per cent of India’s population. The panel’s report was based on the 1931 census. The National Sample Survey Organisation had in 2006 pegged the OBC population at 41 per cent.
