COUNTING OF TRAINING PERIOD FOR MACPS - Dte Order Dt 23.06.2016

Respected Viewers,

                 I wish to share the following on the counting the period of Induction and practical training for MACPS in the Department Of Posts. Hitherto the training period has not been taken into account for the grant of promotion under MACPS. On perusal of the rulings on the subject, it seems that the period of training is to be taken into account for MACPS also. Whether this period is included for MACPS in other circles, is not known.

                 A kind reference is invited to the following orders on the subject.                     
           
1.Dte letter no 4-7/(MACPS)/2009-PCC dt 18.9.2009

2. Dte letter no 4-7/(MACPS)/2009-PCC dt 23.6.2016

            All the candidates selected for PA cadre are to undergo Induction and practical training for 90/105 days, before regular appointment.

1.      Such period of training was not counted for anything and their pay and allowances, increments were regulated from their actual date of joining in the department as Postal Assistants.

2.      Subsequently, orders were issued for counting the training period for increments and for the promotions (financial upgradations) under TBOP and BCR schemes, vide Dept. of Personnel and Trg OM 16/16/92-Estt(pay I) dt 31.3.1992.

3.      The above provision was made applicable with effect from 1.1.1986. The pay of the officials was notionally fixed from 1.1.1986 to 30.9.1990 and on actual basis from 1.10.1990.

4.      The above provision was applicable to those officials who underwent training on or after 1.1.1986.

5.      The provision was extended to officials who underwent training before 1.1.86 videDte order number: 44-2/2011-SPB II dated 5.5.2016. The list of officials is called for by DO and the same has been submitted to DO.

6.      The scheme of MACPS was introduced consequent on the implementation of 6th CPC with effect from 1.1.2006.

7.      This scheme was given effect from 1.9.2008 vide reference cited under 1 above.

8.      The salient features of the scheme were given in the Annexure-I to the communication cited under 2 above.

9.      The second sentence of para 9 of the Annexure read as follows: “Service rendered on adhoc/contract basis before regular appointment or pre-appointment training shall not be taken into reckoning. A casual reading of the text gives the meaning that the pre-appointment training shall not be taken into reckoning. Under this context, the training period was omitted for the grant of MACP to the officials, it is presumed.

10.  But a close reading of the above text gives a different but correct meaning. The meaning of the above text may be explained as follows. If the sentence is broken into smaller parts, they read as follows.

a.      Service rendered on adhoc/contract basis before regular appointment shall not be taken into reckoning.

b.      Service rendered on adhoc/contract basis before pre-appointment training shall not be taken into reckoning.

11.  From (a) and (b) above it is clear that only the service, if any, rendered on adhoc/contract basis either before regular appointment or before pre-appointment training shall not be taken into reckoning.

12.  From the above it is clear that pre-appointment training shall count for MACPS, as the above text speaks only about the services rendered on adhoc or contract basis which might before regular appointment or before pre-appointment training, and nothing about the training period.

13.  As per the communication cited under 2 above, the second sentence of para 9 is modified as follows: “service rendered on adhoc/contract basis before regular appointment on pre-appointment training shall not be taken into reckoning.

14.  From the above it is clear that any service rendered on adhoc/contract basis will not count, but the training period counts for the grant of promotion under MACPS. It is added that as per our departmental rules, the training period is neither treated as service on adhocbasis nor on contract basis in as much as this period counts for increment and also for TBOP/BCR promotions.

15.  For clarity sake consider the following rule of our department. “ Air journey on LTC is not permissible” which means that no government servant is entitled for air journey on LTC but LTC can be availed. This does not take away the privileges granted under LTC. The restriction is for air journey only.

16.  Also as per the developments taken place towards the counting of training period for service, the training period counts for increment and TBOP/BCR schemes.

17.  It is added that just like TBOP/BCR schemes, MACPS is also a financial upgradation only. Hence the provision of counting training period towards TBOP/BCR will squarely applicable to MACPS also.

Those officials, who have completed 16/26 years’ service before 1.9.2008, had no problems, as their pay would have been fixed on the date of promotion to TBOP/BCR schemes prior to 1.9.2008. If the training period is included, the date of promotion to TBOP/BCR would be advanced and their pay would be refixed accordingly.

In case of the officials who have got their MACP after 1.9.2008, the date of MACPS is to be advanced.

Minimum broadband speed set to jump 4 times

Tired of poor broadband speed and painfully slow downloads? That's about to change soon, with the Centre looking to mandate a four-fold increase in the minimum broadband speed -- from 512 kbps (kilobits per second) to 2 mbps (megabits per second)."I propose to take up the matter with the communications ministry," IT minister Ravi Shankar Prasad told TOI. "We will consider laying down a policy for increasing the minimum broadband speed from the current levels."
The thriving start-up ecosystem across India and delivery of a variety of consumer services through mobile phone apps, including online retail, taxis and social media, are among the reasons that have led to the push for upgrading the minimum internet speed on wire and wireless networks. The last time minimum internet speed was revised was in August 2014 when it was doubled rom 256 kbps to 512 kbps.

Experts and industry analysts say that the present peed is "abysmally slow" and is inadequate to match up with the fast-developing app eco-system that is fuell ng the growth of internet adoption across the country.

Prasad said that he expected telecom operators across the country to "appreciate" the move, which will now be taken up with the various stakeholders.

Telecom operators in the country are moving to 4G services that promise data peeds in excess of 10 mpbs.The migration to 4G is happening at a time when prices of smartphones handsets are at their lowest levels, with a 4G device being available for Rs 3,000. The government also feels that there is a need to upgrade the speed on fixedline broadband connections that are reaching homes, especially when it has initiated a highly-ambitious broadband outreach programme to connect as many as 2.5 lakh gram panchayats through optic fibre cable network called `BharatNet'.

According to a report by global content network Akamai, South Korea has the fastest average connection speed at 29 mbps and is followed by Norway at 21.3 mbps and Sweden at 20.6 mbps (global average is 6.3 mbps).

According to a report by Nasscom and Akamai, India had around 330 million fixed and mobile internet subscriptions as of December 2015. This is expected to witness a growth of approximately 20% over the next five years, taking the total subscriptions to around 730 million by 2020.

Exercise option within Three Months of the Date of Notification

To Exercise option under the provisos to rule 5 with in three months of the Notification of Revised Pay Rule 2016 is issued.
shall be exercised in writing in the form appended to these rules so as to reach the authority mentioned in sub-rule (2) within three months of the date of notification of Revised Pay Rule 2016.
Exercise of option :-
(1) The option under the provisos to rule 5 shall be exercised in writing in the form appended to these rules so as to reach the authority mentioned in sub-rule (2) within three months of the date of notification of these rules or where any revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within three months of the date of such order:
Provided that :-
(i) in the case of a Government servant who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the said authority within three months of the date of his taking charge of his post in India; and
(ii) where a Government servant is under suspension on the 1st day of January, 2016, the option may be exercised within three months of the date of his return to his duty if that date is later than the date prescribed in this sub-rule.
(2) The option shall be intimated by the Government servant to the Head of his Office along with an undertaking, in the form appended to these rules.
(3) If the intimation regarding option is not received by the authority within the time specified in subrule (1), the Government servant shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.
(4) The option once exercised shall be final.
Note 1: Persons whose services were terminated on or after 1st January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned posts, resignation, dismissal or discharge on disciplinary grounds, shall be entitled to exercise option under sub-rule (1).
Note 2: Persons who have died on or after the 1st day of January, 2016 and could not exercise the option within prescribed time limit are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date as is most beneficial to their dependents if the revised pay structure is more favorable and in such cases, necessary action for payment of arrears shall be taken by the Head of Office.
Note 3: Persons who were on earned leave or any other leave on 1st day of January, 2016 which entitled them to leave salary shall be entitled to exercise option under sub-rule (1).

Why we are participating in the 2nd September 2016 strike

We are aware that National Trade Union Centers of our Country have given a clarion call for workers to participate in the 2nd September strike on 12 point Charter of Demands. 
The strike matters were discussed among the FNPO affiliated General Secretaries personally and debated on a marathon hours and consensus was reached to participate in the 2nd Sep 2016. 
Strike taking into consideration of anti-labour attitude of the Government. Mainly FNPO General Secretaries discussed issues relating to 7th CPC and its implications which affect the Central Government employees in the long run. Though the Government agree to appoint three committees on minimum wages, allowances and new Pension Scheme, we cannot presume the favorable recommendations of the committees at this stage.
Unilateral amendments to the Labour laws by the present Government will affect the trade union movement of the country. If we are away from the strike, we will be blamed by the future generations.
By participating in the one day strike can we change the scenario of the nation was also discussed by the General Secretaries at length. Finally we decided non-participation in the strike will affect the organization. The results are not important but organization is important. That is why we are participating in the strike.
Some of the unions are in the habit of participating in the one day strike to keep up their entity in their political arena and to achieve personal political ambitions.
Though we belong to INTUC, we have no political ambitions to improve our position in future. We are worried about the labour movement in general and welfare of Postal employees in particular. The postal Department is already functioning with huge shortage of staff and the Department is planning to outsource our permanent jobs through private agencies. This has already been implemented in the many international countries. Now the India Post started outsourcing vigorously. This will affect future employment to the citizens permanently. If we do not participate in the strike, we will become dishonest to the trade union movement.
There are many issues which we cannot express openly . But the FNPO is firm participating in the strike only to protect the labour movement in the country and not binding for any pressure.
We appeal to all our Divisional / Circle Secretaries to organize one day strike on 2-9-2016 successfully and make this strike a thundering success.

The India Post Payments Bank Limited has received the Certificate of Incorporation from the Registrar of Companies, Ministry of Corporate Affairs yesterday under the Companies Act 2013. This would be the first PSU under the Department of Posts. This has happened in the wake of Prime Minister Shri Narendra Modi’s Independence Day address, raising the expectations of the people from the soon to be set up India Post Payments Bank. With this move the Department of Posts has cleared an important milestone on this journey.

With the incorporation, the Board of the India Post Payments Bank Limited is likely to be constituted soon. The incorporation of the IPPB Ltd is a significant step forward as this also paves the way for the bank to begin hiring of banking professionals to set up the bank and begin its operations in 2017. The Department of Posts is expected to complete the roll out of its branches all over the country by September 2017. This could be the fastest roll out for a bank anywhere in the world.

The aspiration for the India Post Payments Bank is to become the most accessible bank in the world riding on state of the art banking and payments technology. Coupled with the physical presence across 1.55 lakh post offices and the reach of “The Dakiya”, the India Post Payments Bank aims to become a powerful and effective vehicle of real financial inclusion in the country. OFFICE MEMORANDUM

Subject: Setting up of Anomaly Committee to settle the Anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.

The undersigned is directed to say that it has been decided that Anomaly Committees should be set up, consisting of representatives of the Officials Side and the Staff Side to settle the anomalies arising out of the implementation of the 7th Pay Commission’s recommendations, subject to the following conditions, namely:
(1) Definition of Anomaly
Anomaly will include the following cases:
(a) where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the Commission assigning any reason; and
(b) where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure, as notified vide CCS (RP) Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules”.
(2) Composition: 
There will be two levels of Anomaly Committees, National and Departmental, consisting of representatives of the Official Side and the Staff Side of the National Council and the Departmental Council respectively.
(3) The Departmental Anomaly Committee may be chaired by the Additional Secretary (Admn.) or the Joint Secretary (Admn.), if there is no post of Additional Secretary (Admn.). Financial Adviser of the Ministry / Department shall be one of the Member of the Departmental Anomaly Committee.
(4) The National Anomaly Committee will deal with anomalies common to two or more Departments and in respect of common categories of employees. The Departmental Anomaly Committee will deal with anomalies pertaining exclusively to the Department concerned and having no repercussions on the employees of another Ministry / Department in the opinion of the Financial Adviser.
(5) The Anomaly Committee shall receive anomalies through Secretary, Staff Side of respective Council upto six months from the date of its constitution and it will finally dispose of all the anomalies within a period of one year from the date of its constitution. Any recommendations of the Anomaly Committee to resolve the anomaly shall be subject to the approval of the Government.
(6) Cases where there is a dispute about the definition of “anomaly” and those where there is a disagreement between the Staff Side and the Official Side on the anomaly will be referred to and “Arbitrator” to be appointed out of a panel of names proposed by the two sides. However, this arbitration will not be a part of the JCM Scheme.
(7) The Arbitrator so appointed shall consider the disputed cases arising in the Anomaly Committees at the National as well as Department level.
(8) Orders regarding appointment of the Arbitrator and constitution of Anomaly Committee at National Level will be issued separately. All Ministries / Departments are accordingly requested to take urgent action to set up the Anomaly Committees for settlement of anomalies arising out of implementation of the 7th Pay Commission’s recommendations, as stipulated above.

2016 September 2nd General Strike 12 Point Charter of Demands of Joint Platform of Central Trade Unions submitted to government
PART – A
1.     Urgent measures for containing price rise through universalization of public   distribution system and banning speculative trade in commodity market.
2.     Containing unemployment through concrete measures for employment generation.
3.     Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
4.     Universal social security cover for all workers.
5.     Minimum wage of not less than 18000/- per month with provisions of indexation (for unskilled worker).
6.     Assured enhanced pension not less than 3000 p.m for the entire working population (including unorganized sector workers).
7.     Stoppage of disinvestment in Central/state public sector undertakings.
 8.     Stoppage of contractorisation in permanent/perennial work and payment of same wage and benefits for contract workers as that of regular workers for the same and similar work.
 9.     Removal of all ceilings on payment and eligibility of bonus, provident fund and increase in quantum of gratuity.
10.Compulsory registration of trade unions within a period of 45 days from the date of submitting application and immediate ratification of ILO conventions C-87 & C-98.
11.No FDI in Railways, Defence and other strategic sectors.
12.No unilateral amendment to labour laws.
PART – B:  (CGE & POSTAL DEMANDS)
1.   Avoid delay in implementing the assurances given by Group of Ministers to NJCA on 30thJune 2016, especially increase in minimum pay a fitment formula. Implement the assurance in a time bound manner.
 2.     Settle issues raised by the NJCA, regarding modifications of the 7th CPC recommendations, submitted to Cabinet Secretary on 10th December 2015.
3.     Scrap PFRDA Act and New Pension System (NPS) and grant Pension/Family Pension to all Central Government employees under CCS (Pension) Rules 1972.
4.     No privatization, outsourcing, contractorisation of Government functions.
5.     (i) Treat Gramin Dak Sevaks as Civil Servants and extend all benefits on pay, pension and allownaces of departmental employees.
(ii) Regularise casual, contract, contingent and daily rated workers and grant equal pay and other benefits.
6.     Fill up all vacant posts by special recruitment. Lift ban on creation of new posts.
7.     Remove ceiling on compassionate appointments.
8.     Extend benefit of Bonus Act amendment 2015 on enhancement of payment ceiling to the Adhoc bonus/PLB of Central Govt. employees with effect from the financial years 2014-15. Ensure payment of revised bonus before Pooja holidays.
9.     Revive JCM functioning at all levels.
10.   Implement Cadre restructuring in left out categories of Postal Department. i.e RMS,MMS,PA CO, SBCO & Postal Accounts etc..
11.  Settle the problems related CBS, CIS & stop harassment and Trade Union victimization.
