JCA decided to go on strike on Postal issues

PJCA meeting held at NFPE office under the Chairmanship of SG, FNPO.  Available General Secretaries of FNPO & NFPE participated in the meeting.

PJCA discussed the appeal of the Department and decided the following:
  • Demanding action taken report on each item given to the department on 17.11.2016
  • PJCA decided to go on strike on Postal issues shortly.  The date of strike and issue of strike notice will be decided shortly.

Demonetisation puts Bank Employees under stress – Bank Unions plan Demonstrations on Dec. 28

Employees Association (AIBEA) and the All India Bank Officers Association (AIBOA) have given a call for demonstration against the problems that various banks and their employees were facing due to demonetisation.
They plan to undertake demonstrations on December 28, followed by the unions addressing a letter to Union Finance Minister Arun Jaitley on December 29. The unions also plan to stage demonstrations on the issue on January 2 and 3.
AIBEA general secretary C.H. Venkatchalam and his AIBOA counterpart S. Nagrajan, in a statement issued on Tuesday, said: “As per the call of our organisations, already our units have undertaken the programme of demonstrations in all major centres and met the local executives of the RBI to hand over our memorandum.”
The unions have demanded supply of adequate cash to all banks and branches, restoration of all ATMs without further delay and transparency in cash supply to banks.
“If the RBI is not able to supply adequate cash to banks, then decision should be taken to suspend cash transactions in the bank branches till sufficient cash is supplied to banks,” the statement said.
They also demanded a CBI inquiry into the cases of seizure of huge number of new currency with some persons when bank branches are cash starved.
The unions demanded compensation to the families of the persons and bank staff who lost their lives recently due to demonetisation.
They asked the RBI and State governments to ensure safety and protection of bank employees and officers by maintaining law and order in all branches to prevent harassment of the staff.
The Bank employees also demanded proper compensation to employees and officers for their extra work/late sittings done in the last more than a month.
Both the unions claim to have over 5.50 lakh members out of the nearly 9 lakh bank employees in the country.

Government Clarification on Amendment to Payment of Wages Act 

It is seen from the media reports that there is a general impression that is being created that the Government is bringing an amendment to the Payment of Wages Act to make mandatory the payment of wages to the workers only through cheque or accounts transfers. This is not the correct position.

It is clarified that the government proposes to bring an amendment to Section 6 of the Payment of Wages Act which will further provide crediting the wages in the bank account of the employees or payment through cheque along with the existing provisions of payment in current coin or currency notes.

This is being done to facilitate the employers from making payment of wages using the banking facilities also in addition to the existing modes of payment of wages in current coin or currency notes.

Also, the appropriate Government (Centre or State) will have to come up with the notification to specify the industrial or other establishments where the employer shall pay wages through cheque or by crediting the wages in employees’ bank account. It is, therefore, clear that the option of payment through cash is still available with the employers for payment of wages.

It may be understood that the Payment of Wages Act was passed in the year 1936 (eighty years ago) and the situation prevailing at that point of time has completely undergone a technological revolution. Most of the transactions now take place through the banking channels. The proposal of Ministry of Labour and Employment to bring an amendment to Section 6 of the Act is an additional facility of crediting the wages in the bank account of the employees or payment through cheque along with the existing provisions of payment in current coin or currency notes.

The above proposed amendment will also ensure that minimum wages are paid to the employees and their social security rights can be protected. Thus the employers can no longer under-quote the number of employees employed by them in their establishments to avoid becoming a subscriber to the EPFO or ESIC schemes.

It is also pointed out that the states like Andhra Pradesh/Telangana, Kerala, Uttarakhand, Punjab and Haryana have already come out with notifications to provide for payment through banking channels.

First India Post Payments Bank (IPPB) Branch in January 2017

Ranchi: India Post, Jharkhand, will become the first in the country to open a bank branch India Post Payments Bank (IPPB) in January.

The basic preparations in terms of infrastructure, manpower and training have been completed.

The move to came after Prime Minister Narendra Modi announced that all post offices should be converted to banks by January next year. The IPPB was incorporated as a public limited company, under the department of posts, Government of India, in August 2015 with 100% government equity.

Postmaster General, Jharkhand circle, Anil Kumar said that the first bank branch will begin operations at GPO, Doranda, for which a separate building has been constructed. "Once the GPO branch becomes functional, all other post offices in the state will also start functioning," Kumar said.

There are more than 2,800 India Post offices across the state and the number is likely to be increased to 3,400. "In addition, we have over 100 panchayat seva kendras (PSK) and over 4,000 postmen who can work as business correspondents," Kumar said.

The postmen are being provided with PoS machines. Officials will not only receive money for deposits and disburse payments but will also open new accounts, sell insurance instruments and register money orders. At present, the postal department has issued kits to over 2,700 post offices, which includes a biometric device, printer and a tab for digital transactions.

Kumar said that more than 500 people have already been trained on financial inclusion tools, the usage of PoS machines and briefed on the functioning of post offices as business correspondents. "We have hired experts from Infosys and Rico for training our staff and the training is going on in Ranchi and Jamshedpur," Kumar said.

India Post has also issued debit cards to saving account holders in post offices and once the banking facility begins, more debit cards will be issued. "It will work as full-fledged banks in the wake of the existing robust infrastructures in the remote corners of the state," Kumar said.

Out of 456 post offices, 358 have already been brought on the CBS platform and this is all set to boost the banking structure of Jharkhand post offices once the headquarter branch becomes operational.

Subject: Restriction on Deposit of WOS Notes into SB Account 

        Kindly refer to the SB Order No. 12/2016 dated 08.11.2016 (Para No. 02 (iii) ) regarding deposits of WOS Notes. There is a partial modification in the acceptance of deposits of WOS notes. RBI vide their notification number RBI/2016-17/189 DCM (Plg) No. 1859/10.27.00/2016-17 dated 19.12.2016 has decided to place certain restrictions on deposit of SBNs (Specified Bank Note/WOS Notes) into the accounts by allowing deposits in excess of Rs. 5000/- will be received for credit only once during the period till December 30th, 2016. Copy of the RBI notification is attached herewith. 

It is requested to kindly issue necessary instructions to all concerned in this regard.

Our stand on GDS committee report :
Today after attending Departmental council  meeting, FNPO affiliated General Secretaries along with Secretary General of  FNPO Shri.Thiyagarajan met Chairman Postal Services Board and requested him to release the GDS committee report which was submitted on 24-11-2016.
After discussion FNPO Secretariat  met and took the following decision.
1) Not to conduct any agitational programme up to31st December 2016 pressurising the publication of GDS committe report.
2) FNPO is not interested on agitation Programme for release of report. But will insist the Department to implement all Positive recommendations of GDS committee.
In view of this we appeal to all our colleagues to be patient  up to December end. If Department did not intiate action to release the report FNPO secretariat will meet and decide further course of action

Letter to the Hon PM by FNPO & its Affiliated Unions

LETTER TO THE HONOURABLE PRIME MINISTER OF INDIA BY FNPO AND ITS AFFILIATED UNIONS / ASSOCIATIONS.

 Respected Sir,

We, the Federation of National Postal Organisation and its affiliated unions submit this letter to express our deep concern and request to honour the commitment given by the Group of Ministers in the meetings held with JCM (Staff Side) leaders on 30th June 2016 & 06th July 2016.

Subsequently, an assurance was given that a High-Level Committee will examine the 7th CPC issues, mainly the Minimum Wage and Multiplying Factor. Based on the assurance, the JCM Constituent deferred the Strike action on 06th July 2016.

Though a Committee was constituted under the chairmanship of Addl. Secretary (Exp), Ministry of Finance and discussions held, the response has been disappointing.

The employees of the Postal and other Central Government employees are greatly disappointed over the non-settlement of the main issues.

More so, many of the recommendations of the 7th CPC have created unrest in the minds of Central government employees in general and Postal employees in particular.

The issues raised after the implementation of 7th CPC & other long pending issues are enclosed.

We request your kind attention to the issues listed in the enclosure and action thereof at the earliest.

THE ISSUES RAISED AFTER THE IMPLEMENTATION OF 7TH CPC & OTHER LONG PENDING ISSUES
 
 1. Request to Settle the demands raised by NJCA regarding modifications of 7th CPC recommendations as submitted in the memorandum to Cabinet Secretary on 10th December 2015. Honour the assurance given by the Group of Ministers to NJCA on 30th June 2016 and 6th July 2016, especially the increase in minimum wage and fitment factor. Grant revised HRA, at the existing percentage itself, i.e. 30%, 20% and 10%. Accept the proposal of the staff side regarding Transport Allowance. Settle all anomalies arising out of the implementation of 7th CPC recommendations, in a time bound manner.
 2. Request to Implement option-I recommended by 7th CPC and accepted by the Government regarding parity in pension of pre-2016 pensioners, without any further delay. Settle the pension related issues raised by NJCA against item 13 of its memorandum submitted to Cabinet Secretary on 10th December 2015.
 3. Request to Scrap PFRDA Act and New Pension System (NPS) and grant pensions and Family Pension to all Central Government employees recruited after 01.01.2004, under CCS (Pension) Rules 1972.
 4. Request to Treat Gramin Dak Sewaks of Postal department as Civil Servants, and extend all benefits like pay, pension, allowances etc. of departmental employees to GDS.
 5.Request to Regularise all casual, contract, part-time, contingent and Daily rated mazdoors and grant equal pay and other benefits. Revise the wages as per 7th CPC minimum pay
6. Request to avoid Downsizing, Privatisation, outsourcing and contractorisation of Government functions.
7. Request to Withdraw the arbitrary decision of the Government to enhance the benchmark for performance appraisal for promotion and financial upgradations under MACP from “GOOD” to VERY GOOD” and also decided to withhold annual increments in the case of those employees who are not able to meet the bench march either for MACP or for regular promotion within the first 20 years of service. Grant MACP pay fixation benefits on promotional hierarchy and not on pay-matrix hierarchy. Personnel promoted on the basis of examination should be treated as a fresh entrance to the cadre for grant of the MACP.
8. Request to Withdraw the draconian FR 56 (J) and Rule 48 of CCs (Pension) Rules 1972 which is being misused as a shortcut as a purity measure to punish and victimize the employees.
9. Request to Fill up all vacant posts, including promotional posts in a time bound manner. Lift ban on creation of posts.
10. Request to remove 5% ceiling on compassionate appointments and grant appointment in all deserving cases.
11. Request for Grant five promotions in the service career to all Central Govt. Employees..
12. Request to Reject the stipulation of 7th CPC to reduce the salary to 80% for the second year of Child Care leave and retain the existing provision.
13. Request for Ensure cashless medical treatment to all Central Government employees & Pensioners in all recognized Government and Private hospitals.
14. Request to Revision of Overtime Allowance (OTA) and Outstation allowance (OSA) w.e.f 01.01.2016 based on 7th CPC pay scale.
15. Request to Revision of wages of Central Government employees in every five years. 16. Request to Revive JCM functioning at all levels.

RBI Imposes Restrictions On Withdrawal From Certain Bank Accounts

The Reserve Bank imposed certain restrictions on withdrawal if more than Rs 2 lakh has been deposited after November 9 in an account which has a balance of over Rs 5 lakh.

 Mumbai: Tightening the noose around people who misused banking channels to park unaccounted money, the Reserve Bank on Thursday imposed certain restrictions on withdrawal if more than Rs 2 lakh has been deposited after November 9 in an account which has a balance of over Rs 5 lakh.

As per a RBI notification, withdrawal or transfer of funds will not be permitted in accounts without quoting of PAN or submission of Form 60 (persons who do not have PAN).

The Reserve Bank also said monthly withdrawal limit of Rs 10,000 will be maintained even if a 'small account' has witnessed increase in annual permissible deposit of Rs 1 lakh.

The notification follows after it was brought to the notice of the RBI that "strict compliance" with KYC (Know Your Customer) provisions is not being ensured in some cases.

In respect of KYC compliant accounts where the required Customer Due Diligence (CDD) procedure has been complied with, RBI said banks and NBFCs should ensure compliance regarding quoting of PAN/obtaining of Form 60 for all transactions.

"No debit transaction, transfer or otherwise shall be allowed in accounts which do not comply with the above mentioned requirements.

"To begin with, this rule shall be strictly applied in accounts where both the thresholds listed -- (i) balance of rupees five lakh or more; and (ii) the total deposits (including credits by electronic or other means) made after November 9, 2016, exceed rupees two lakh," RBI said.

RBI further said if any account is rendered ineligible for being classified as a small account due to credits/balance in the account exceeding the permissible limits, withdrawals may be allowed within the limit prescribed for small accounts.

The monthly limit for withdrawal and transfer from a small account is Rs 10,000. Also, aggregate of all credits in a financial year cannot exceed Rs 1 lakh.

Basic Savings Bank Deposit Accounts (Jan Dhan accounts are akin to BSBDAs), which are not KYC compliant accounts are to be treated as 'small accounts', the RBI added.

Government demonetised old Rs 500/1000 from November 9.

Earlier, RBI had asked banks to strictly follow norms while allowing deposits in dormant accounts.

There have been reports some people misused Jan Dhan and dormant accounts to deposit unaccounted money following demonetisation.
